Transferring my Mortgage
ESM Mortgage and Title Services performs the following administrative tasks for real estate transactions (with lawyer direction and supervision applied to the steps that require it under the Law Society of Alberta’s rules)*:
Receive mortgage documents from your new provider
Request a payout statement for the current mortgage associated with the property
Request and receive a Land Title Search and Municipal Property Tax Certificate for the property
Prepare a summary of adjustments/ disbursements and a document package
Arrange a signing session with the Notary or Lawyer to witness signing of documents (included in standard service pricing)
Collect any additional funds required to complete the transaction (e.g., bank processing fees or penalties and payments)
Arrange for the receipt of funds from your new mortgage provider and disbursement of the funds by courier as instructed (e.g. to your former mortgage provider) through the legal trust account of the lawyer handling your file
Register replacement of the mortgage provider with Land Titles

Property Sale
ESM Mortgage and Title Services performs the following administrative tasks for real estate transactions (with lawyer direction and supervision applied to the steps that require it under the Law Society of Alberta’s rules)*:
Receive property sale documents from your Realtor
Request a payout statement for the mortgage associated with the property
Request and receive a Land Title Search and Municipal Property Tax Certificate for the property
As appropriate, request (from the seller) and receive an estoppel certificate from the condo board or Home Owners Association (seller is responsible for this cost)
Prepare a summary of adjustments/ disbursements and a document package
Arrange a signing session with the Notary or Lawyer to witness signing of documents (included in standard service pricing)
Provide a Transfer of Land and other required documents to the buyer’s lawyer or their administrative contact
Arrange for the receipt of funds from the buyer and disbursement of funds by e-transfer through the legal trust account of the lawyer handling your file (included in standard service pricing)
Provide confirmation for property possession
Request your mortgage provider, upon receipt of funds, discharge the mortgage from the property’s land title

We provide administrative services, and all legal services are provided independently by an Independent Liscenced Alberta lawyer that you choose.
When supporting law firms, ESM provides administrative, paralegal, law‑clerk, and intake‑related services. Lawyer direction and supervision apply to tasks that relate to legal matters and only where required under Law Society rules, solely to assist in the efficient delivery of the lawyer’s services. All legal services are provided exclusively by the independent licensed lawyer, who retains full responsibility and control over all legal work and professional judgment.
ESM also offers the same independent non‑legal administrative closing services as a separate option to homeowners. These services are administrative and non‑legal in nature. Any tasks that relate to legal matters — and only where required under Law Society rules — will be performed under the direction and supervision of the independent licensed lawyer chosen by the homeowner. The lawyer may offer a limited retainer option in which ESM collects the total amount payable and forwards the lawyer’s portion as a third party payer.
ESM handles the administration, and the lawyers handle the legal work.
Home Purchase
ESM Mortgage and Title Services performs the following administrative tasks for real estate transactions (with lawyer direction and supervision applied to the steps that require it under the Law Society of Alberta’s rules)*:
Receive property purchase documents from your Realtor
Request and receive a Land Title Search and Municipal Property Tax Certificate for the property
As appropriate, receive from the seller’s agent an estoppel certificate from the condo board or Home Owners Association (Seller is responsible for this cost)
Receive from the sellers agent the Transfer of Land
Prepare a summary of adjustments/ disbursements and a document package
Collect any additional funds required to complete the transaction (e.g., provincial fees for additional amounts, bank processing fees, penalties or payments)
